All marital property is subject to Equitable Distribution during the divorce. If you and your spouse cannot agree on how the property will be distributed, the Court can assist you.
Marital property includes your marital residence, any vacation home(s), retirement assets, including your 401(k), or 403(b), and pensions, including military pensions. Before you and your spouse can obtain a divorce, you must decide how the marital property will be divided.
In the end, you can file a Property Settlement Agreement, outlining the agreed distribution of property. If you and your spouse cannot come to an Agreement, the Court will divide the property in your divorce.
